In Virginia, "how long do points stay?" has two answers, because the demerit points and the conviction behind them come off your record on different clocks. Here is how each generally works.

Demerit points: two years from the offense
Per the Virginia DMV, demerit points remain on your record for two years from the date you commit the offense. Violations are assigned 3, 4, or 6 demerit points depending on severity, and those points count against your balance during that two-year window.
The conviction stays longer than the points
The Virginia DMV is explicit that the dates demerit points are removed are not the same as the dates a conviction is removed. A conviction can stay on your Virginia record much longer than the points - commonly three, five, or eleven years depending on the violation. So your point balance can return to zero while the conviction is still on the record.
Safe driving points work the other way
Virginia also has safe driving points, which count in your favor:
- You earn one safe driving point for each full calendar year with a valid Virginia license and no violations or suspensions.
- You can accumulate a maximum of +5 safe driving points.
- Completing a DMV-approved driver improvement clinic may add safe driving points, as determined by the DMV.
